ICAD ENERGY SURVEYS LTD
Part 1 – SAP Assessments
Energy rating assessments are prepared in accordance with the Building Regulations 2006 Parts L1a and L1b together with conventions contained in SAP 2005 published by DEFRA for SAP version 9.8 dated October 2005.
Clients are responsible for providing the required information to enable the On Construction Domestic Energy Assessor to carry out the energy rating assessment.
The energy rating assessments are prepared by the On Construction Domestic Energy Assessor based on the information submitted by clients and it is the Client’s duty to ascertain from the reports produced that the input information is correct.
The energy rating assessments are prepared with software and issued by personnel under license as approved by the Secretary of State indicated by the use of the SAP logo, and On Construction Domestic Energy Assessor are trained, tested and examined by approved persons. Quality assurance of the work of On Construction Domestic Energy Assessors is carried out by the accreditation body, Elmhurst Energy Systems Limited, who in turn are regulated by The Communities and Local Government Department of the Government.
Energy rating assessments are based on information supplied to the On Construction Domestic Energy Assessor and are not an endorsement of a particular product or system.
The On Construction Domestic Energy Assessor shall undertake energy rating assessments with reasonable care skill and diligence. No liability can be accepted for errors arising subsequently. Under the Building Regulations, it is the responsibility of the Builder to ensure that the project meets the required standards.
The On Construction Domestic Energy Assessor operates under a Code of Conduct issued by Elmhurst Energy Systems Limited from whom a complete copy of the Code of Conduct for On Construction Domestic Energy Assessor may be obtained.
Energy Rating Calculations are based upon three stages:
- As-designed
- As-built
- EPC
Fees quoted will initially be payable upon presentation of the as-built reports and shall be settled by the Client in full within 30 days of the date of the invoice. Additional fees, may, in some cases be payable upon presentation of the as-built reports and shall be settled by the client in full within 30 days of the date of the invoice.
Part 2 – Air Tightness Testing
DWELLINGS (DOMESTIC)
The total value of the fee is as per ICAD Energy Surveys Ltd’s quotation; the quotation may assume a minimum of plots being available to test per visit to a site. Where this is not available the fee shall be as per the quoted fee schedule. Cancellations must be made twenty-four (24) hours in advance of the scheduled test date. Additional visits required as a result of test failures, or where plots have not been available to test, for reasons beyond ICAD Energy Surveys Ltd’s control, and have not been cancelled with twenty-four hours’ notice, will be charged as per the fee schedule provided with the quotation.
All test prices are quoted inclusive of travel with respect to tests within mainland England, Wales, and Scotland. All other quotations will be subject to a travel cost premium that will be provided upon request.
Cancellations on the day of testing will be charged at the full test fee including any weekend or out of hours supplement. The costs will be charged to the Main/Sub Contractor which issued the original instruction to attend. If notice is given after 12 noon, less than 3 working days prior to the test date, an additional fee will be charged. (Notice is needed by 12 noon Tuesday for a Friday or weekend test date).
The fees payable by the Client will be in accordance with the schedule shown in the Proposal provided by ICAD Energy Surveys Ltd
See Invoices for payment details. All Payments will be paid by BACS Bank Transfer to the ICAD Energy Surveys Ltd Bank Account.
Any variations to the work content will be agreed in writing by ICAD Energy Surveys Ltd and the Client and ICAD Energy Surveys Ltd reserves the right to provide a new schedule of fees against the new work programme.
In the event of ICAD Energy Surveys Ltd agreeing with a representative of the Client to carry out any work without the Client’s written acceptance of a quotation, then ICAD Energy Surveys Ltd shall be entitled to reasonable remuneration for the work performed.
Unless otherwise indicated in the Proposal ICAD Energy Surveys Ltd reserves the right to submit regular progress claims monthly in arrears. In exceptional cases of significant setup or travel costs, ICAD Energy Surveys Ltd can require pre-payments.
Where expenses are to be charged in addition to a contract fee the Client agrees to reimburse ICAD Energy Surveys Ltd for all reasonable travel, subsistence, and incidental expenses without further authorisation. In the case of expenses incurred abroad, ICAD Energy Surveys Ltd will invoice in Sterling based on the actual exchange rate prevailing at the time of the transaction.
The Client shall pay for all costs and charges incurred by ICAD Energy Surveys Ltd in collecting any Equipment for testing and in packing and returning the Equipment after testing.
ICAD Energy Surveys Ltd reserves the right to dispose of any equipment not returned to or collected by the Client 28 days after dispatch of the report unless alternative arrangements are agreed as part of a proposal. The Client will be liable for any costs incurred in terms of transport, disposal of hazardous waste etc.
All quotations issued exclude VAT and local taxes unless otherwise stated, VAT and local taxes will be added at the rate ruling at the date the invoice is submitted.
Invalid Test Policy
In the case of an Invalid Test, the customer is still chargeable for the test. An Invalid test is where the whole building is not ready to be tested by way of not achieving enough Building Pressure to conduct a test. This may be due to insufficient sealing, fittings not correctly installed (bathrooms and kitchens) or large unsealed wholes to the outside.
Limitation of Liability
ICAD Energy Surveys Ltd shall exercise all reasonable skill, care and diligence in the discharge of the duties performed and in producing any report, calibration certificate, information or advice. However, ICAD Energy Surveys Ltd shall not be liable for any loss or damage, whether direct or indirect, arising from the use of reports, calibration certificates, information or advice issued by it.
ICAD Energy Surveys Ltd shall not be liable for any damage, loss or expense suffered by the Client by reason of any delay in carrying out any test, investigation or consultancy or in issuing any reports, calibration certificates, information or advice to the Client
The liability of ICAD Energy Surveys Ltd for loss or damage to any Equipment on the premises of ICAD Energy Surveys Ltd by fire, theft or accident shall be limited to £100 or the cost of manufacturing such Equipment if less than £100 plus VAT or any other applicable taxes.
Operation of Contract
The Client shall nominate a suitable representative from within their organisation to act as a liaison between the Client and ICAD Energy Surveys Ltd.
All commitments with respect to the timing and scope of a project given to the Client by ICAD Energy Surveys Ltd – whether verbal or written are made in good faith. ICAD Energy Surveys Ltd agrees to use its best endeavors to fulfill such commitments to the Client on the timing and the scope of consultancy and other projects but it does not guarantee performance in either respect.
Confidentiality
ICAD Energy Surveys Ltd agrees to hold all information provided by the Client confidential where the Client so specifies, save where such information is known to ICAD Energy Surveys Ltd already, or exists already in the public domain, until, either the information enters the public domain, or ICAD Energy Surveys Ltd is given the same information by a third party or is released from its confidentiality requirement by the Client, or the Client is found in breach of contract with ICAD Energy Surveys Ltd by a court of law (including non-payment of account) or three years have elapsed – whichever is the sooner. See exception to this Clause under Clause L1.3 related to misrepresentation and misuse of information.
The Client agrees to hold confidential all information contained within and concerning about ICAD Energy Surveys Ltd’s Proposal(s), fee structures, fees, and personnel.
